Agreement Between User and Aloythecat.com

Welcome to Aloythecat.com (the “Site”). The Site is operated by Jo Knows LLC (“Jo Knows LLC,” “we,” “us,” or “our”).

Aloythecat.com offers merchandise and services that may include Aloy the Cat™ products, ATC CARES™ awareness merchandise, custom-designed products, apparel, drinkware, gifts, trading cards, NASCAR die-cast products, memorabilia, collectibles, and other merchandise.

Your use of Aloythecat.com is conditioned upon your acceptance of these Terms & Conditions (“Terms”). By accessing, browsing, purchasing from, or otherwise using the Site, you agree to be bound by these Terms.

Please read these Terms carefully.

Privacy

Your use of Aloythecat.com is also subject to our Privacy Policy, which explains our practices regarding the collection, use, and protection of information.

Please review the Privacy Policy available on the Site.

Electronic Communications

Visiting Aloythecat.com, submitting forms through the Site, or sending electronic communications to Jo Knows LLC constitutes electronic communication.

You consent to receive communications from us electronically and agree that agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.

Accounts

If you create an account on Aloythecat.com, you are responsible for maintaining the confidentiality of your account information and password and for restricting access to your account.

You agree to accept responsibility for activities occurring through your account or password.

You may not assign or otherwise transfer your account to another person or entity.

Jo Knows LLC reserves the right to refuse or cancel service, terminate accounts, or remove or edit content when reasonably necessary, subject to applicable law.

Children

Jo Knows LLC does not knowingly collect personal information from children under the age of 13 except as permitted by applicable law.

Individuals under the age of 18 should use the Site and make purchases only with the involvement and permission of a parent or legal guardian.

Products and Product Information

We make reasonable efforts to provide accurate product descriptions, photographs, pricing, specifications, colors, dimensions, and other information.

Because many products are handmade, customized, made to order, or produced using processes such as heat transfer, sublimation, or similar production methods, minor variations may occur between the product shown online and the finished item.

Colors may also appear differently depending on a customer's screen, device, or display settings.

Such minor variations do not necessarily constitute a product defect.

Made-to-Order and Custom Products

Many products offered through Aloythecat.com are made to order or customized after an order is placed.

Customers are responsible for reviewing names, dates, spelling, images, sizes, colors, personalization information, and other selections before submitting an order.

Production cannot always be stopped once work has begun.

Customized or personalized products may be subject to different cancellation, return, or refund restrictions than standard merchandise. Please review the applicable product description and Return & Refund Policy before purchasing.

Pricing

Prices displayed on Aloythecat.com are subject to change without notice.

We reserve the right to correct typographical errors, pricing errors, product-description errors, or other inaccuracies.

If an error affects an order that has already been submitted, we may contact the customer regarding the error and, where appropriate and permitted by law, cancel and refund the affected order.

Applicable taxes and shipping charges may be added during checkout.

Orders

Submitting an order does not necessarily constitute final acceptance of the order by Jo Knows LLC.

We reserve the right to refuse or cancel an order when reasonably necessary, including in cases involving suspected fraud, unauthorized transactions, product availability issues, obvious pricing or listing errors, inability to fulfill customization requirements, or violations of these Terms.

If we cancel an order after payment has been processed, the applicable payment will be refunded.

Production and Processing Times

Many products sold through Aloythecat.com are individually made to order.

Estimated production and processing times are provided on the Site or applicable product listing. These timeframes are estimates and may vary due to order volume, material availability, equipment issues, holidays, carrier delays, or other circumstances.

Shipping transit time is separate from production and processing time.

Shipping

Shipping charges are calculated according to the shipping policies and rates displayed on Aloythecat.com.

We currently ship to eligible addresses within the United States, including APO, FPO, and DPO military addresses where supported by the applicable carrier.

Additional charges or restrictions may apply to shipments to Alaska, Hawaii, U.S. territories, military addresses, or other destinations depending upon carrier requirements.

Customers are responsible for providing a complete and accurate shipping address.

Once an order has been transferred to the shipping carrier, delivery times may be affected by circumstances outside the reasonable control of Jo Knows LLC.

Please refer to our Shipping Policy for current shipping rates, free-shipping thresholds, estimated processing times, and additional shipping information.

Cancellations, Returns, and Refunds

Cancellations, returns, exchanges, and refunds are governed by the Return & Refund Policy published on Aloythecat.com.

Eligibility may vary depending upon whether an item is standard merchandise, made to order, personalized, customized, damaged, defective, or incorrectly fulfilled.

Nothing in these Terms limits any rights or remedies that cannot legally be limited under applicable consumer-protection laws.

Trading Cards, Collectibles, Memorabilia, and NASCAR Products

Certain trading cards, collectibles, memorabilia, NASCAR die-cast products, and similar merchandise may be unique, vintage, previously owned, limited edition, professionally graded, or otherwise sold based upon the specific condition described in the product listing.

Customers should carefully review photographs, grading information, condition descriptions, and other listing details before purchasing.

When a third-party grading or authentication service is identified, any grade or authentication designation is attributable to that third-party service and not independently issued by Jo Knows LLC unless expressly stated otherwise.

ATC CARES™ and Charitable Giving

Certain products offered through Aloythecat.com may be designated as part of ATC CARES™ or another charitable or awareness initiative.

When a product includes a charitable contribution, the applicable product page or ATC CARES™ information on the Site will identify the contribution or donation associated with the purchase.

Charitable partners, donation amounts, participating products, and programs may change over time. Current information displayed on the Site at the time of purchase will govern the applicable purchase.

Unless expressly stated otherwise, purchases made through Aloythecat.com are purchases of merchandise and are not direct charitable donations by the customer.

Custom Designs and Customer-Provided Content

Customers requesting customized products may provide photographs, logos, artwork, text, names, or other materials (“Customer Content”).

By providing Customer Content, you represent that you own the content or have all permissions, licenses, and rights necessary for Jo Knows LLC to reproduce and use the content for the purpose of producing your requested product.

You agree not to submit Customer Content that infringes another person's copyright, trademark, privacy, publicity, or other legal rights.

Jo Knows LLC reserves the right to decline custom work that we reasonably believe may violate applicable law or third-party rights.

Providing Customer Content does not transfer ownership of that content to Jo Knows LLC. You grant Jo Knows LLC only the rights reasonably necessary to process, produce, and fulfill your requested product or service.

Intellectual Property

Unless otherwise stated, the content available through Aloythecat.com—including original text, graphics, photographs, logos, designs, artwork, product designs, page layouts, and other original materials—is owned by or licensed to Jo Knows LLC and is protected by applicable intellectual-property laws.

Aloy the Cat™, ATC CARES™, associated branding, logos, designs, and other proprietary materials may not be reproduced, copied, distributed, sold, modified, or commercially exploited without authorization from Jo Knows LLC or the applicable rights holder.

Third-party names, logos, trademarks, characters, sports properties, brands, and other intellectual property remain the property of their respective owners.

Nothing on Aloythecat.com grants a license to use Jo Knows LLC's intellectual property except as expressly authorized.

Prohibited Uses

You agree not to use Aloythecat.com:

• For any unlawful purpose;

• To violate applicable laws or regulations;

• To infringe upon the intellectual-property or other legal rights of another person or organization;

• To transmit malicious software, viruses, or harmful code;

• To interfere with the operation or security of the Site;

• To attempt unauthorized access to accounts, systems, or information;

• To collect information about other users without authorization; or

• To use Site content commercially without appropriate authorization.

Third-Party Links and Services

Aloythecat.com may contain links to websites, payment processors, shipping providers, social-media platforms, or other services operated by third parties.

Jo Knows LLC does not control these third-party services and is not responsible for their content, availability, privacy practices, policies, or actions.

The inclusion of a third-party link does not necessarily constitute endorsement of that third party.

Certain services used by Aloythecat.com may require information to be transmitted to third-party providers as necessary to process payments, fulfill orders, provide shipping, operate Site functionality, or deliver requested services, subject to applicable privacy laws and our Privacy Policy.

International Users

The Site is controlled and operated by Jo Knows LLC from the United States.

Users accessing the Site from outside the United States are responsible for compliance with applicable local laws.

Disclaimer

We make reasonable efforts to keep Aloythecat.com accurate and available. However, the Site may occasionally contain errors, interruptions, outdated information, or technical issues.

To the maximum extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis.

Jo Knows LLC does not guarantee that the Site will always operate uninterrupted or error-free.

Nothing in this section excludes warranties, rights, or remedies that cannot legally be excluded under applicable law.

Limitation of Liability

To the maximum extent permitted by applicable law, Jo Knows LLC and its officers, employees, agents, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from or related to use of the Site or products and services offered through the Site.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the extent permitted by law.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Jo Knows LLC, its officers, employees, agents, and service providers from claims, liabilities, losses, damages, or reasonable expenses arising from your unlawful use of the Site, your violation of these Terms, your infringement of third-party rights, or Customer Content you provide for custom production.

Termination and Access Restrictions

Jo Knows LLC reserves the right to restrict or terminate access to Aloythecat.com when reasonably necessary because of violations of these Terms, suspected fraudulent activity, unlawful conduct, threats to Site security, or other misuse of the Site.

Governing Law

To the maximum extent permitted by applicable law, these Terms are governed by the laws of the State of Maine, without regard to conflict-of-law principles.

Any provision of these Terms determined to be invalid or unenforceable will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

Nothing in these Terms deprives a consumer of rights or protections that cannot lawfully be waived.

Changes to These Terms

Jo Knows LLC reserves the right to update or modify these Terms from time to time.

The most current version will be posted on Aloythecat.com with an updated effective date.

Your continued use of the Site following the posting of revised Terms constitutes acceptance of those Terms to the extent permitted by applicable law.

Entire Agreement

These Terms, together with the Privacy Policy, Shipping Policy, Return & Refund Policy, and other policies expressly incorporated by reference, constitute the agreement between you and Jo Knows LLC concerning your use of Aloythecat.com.
